US Court Dismisses Smuggling Case Against Kilmar Abrego Garcia
(MENAFN) A federal judge has dismissed a human smuggling indictment brought against Kilmar Abrego Garcia by the Trump administration, according to reports.
US District Judge Waverly Crenshaw ruled on Friday that the Department of Homeland Security failed to counter claims of “presumption of vindictiveness” raised by Abrego Garcia, who argued the case was reopened in retaliation following his earlier legal action against the administration.
“Because the presumption of vindictiveness remains unrebutted, the indictment must be dismissed,” Crenshaw wrote in his ruling.
The case stemmed from a November 2022 traffic stop in Tennessee, during which state troopers questioned Abrego Garcia after finding nine individuals in a vehicle without luggage, suspecting possible human trafficking. He was not arrested or charged at the time and was allowed to leave.
According to the judge’s ruling, authorities later reopened the investigation into the incident and linked it to alleged human smuggling activity.
“Instead of investigating the November 2022 traffic stop to identify who was responsible for the human smuggling, (US Acting Attorney General Todd) Blanche started the investigation to implicate Abrego,” Crenshaw wrote.
